The services provided by a Golden Rain maintenance staff service contract are described below. Items covered by your mutual fund are not covered by the Maintenance Personnel Service, although they may appear on the list. Items not covered by the service must be supplied by the resident or can be purchased at the time of the service. The parts must be supplied or paid for by the resident. The resident can purchase the parts, if available, at Golden Rain at the time of service. The parts are subject to availability and Golden Rain assumes no responsibility for any damage or loss related in any way to Golden Rain's alleged failure to supply the parts on time by Golden Rain.
Services requested by the resident after business hours or during holidays will not be covered by this Agreement, regardless of whether they fall within the scope of the services set out in the Service Description List. Golden Rain assumes no responsibility for any damage or loss related in any way to Golden Rain's alleged premature response to any “emergency” or other service request. Under no circumstances may a resident's rights under this Agreement be transferred to an address other than the one at which they were purchased. Golden Rain's total liability for any claim related to the services provided under this Agreement shall in no event exceed the purchase price of the service package.
In addition, Golden Rain will not be responsible for any general or consequential damages that arise from or are in any way related to the services provided under this Agreement. The resident undertakes to defend, compensate and hold Golden Rain harmless for any claim, injury or damage suffered by a Golden Rain employee or agent providing services under this Agreement if such claim, injury or damage is due in whole or in part to the negligent acts or omissions of the resident.
